What is the first step in defending a Will?

Answer

The first step in defending a Will is really quite simple.  Does the person contesting the Will have the right to make a claim, and are they in time to do so.  If they are not eligible, then their claim will be dismissed. HH Legal can advise as to whether those claiming against you are eligible to do so.

  • Spouses
  • Former Spouses
  • Civil partners
  • Children  (adult children fall into this category)
  • Step Children
  • Grandchildren
  • If  they were wholly or partly maintained by the deceased
  • People in close personal relationships who lived with deceased for a period of no less than 2 years

Do not assume that as the person making a claim is not a relative, then they are unable to make a claim.  There are other potential claimants, and each needs to be judged accordingly.  HH legal will be able to advise you as to the merits of any claim.
