Where can it take place?

The most popular place for bullying and harassment to take place is at the workplace. Unfortunately, there is currently no UK legislation in place to protect employees if they have been bullied or harassed in the workplace. However, if you have suffered bullying and harassment, you may still be protected.

How can I be protected against harassment?

If you have been bullied or harassed because of your sex or race, you may well be protected by the Equality Act 2010.

The Public Order Act 1986, Criminal Justice and Public Act 1994 and the Protection from Harassment Act 1997 may be available and offer you some kind of protection, this is something we can discuss with you in greater detail. It possibly means that the employer could be liable for any bullying or harassment committed by a fellow worker.

If you have been victim of bullying and/or harassment, and the consequences resulted in your resignation, the above Act’s may offer you some protection to make a claim for constructive unfair dismissal.
